Industry stakeholders agree that the bill should avoid the negative impacts of section 39, which restricts artists and producers from freely entering contracts and expands the Minister’s authority over private agreements.
The CEO of RiSA, Nhlanhla Sibisi, expressed concerns that some provisions in the bill would interfere with contract freedom, undermine creative works’ protection, create uncertainty, and discourage investment in South African cultural industries.
